Welcome to GLACR. These Terms of Service ("Terms") govern your access to and use of the website located at GLACR.store and your purchase of any products offered through it. The Site is operated by GLACR.
By accessing the Site, placing an order, or otherwise using our services, you agree to be bound by these Terms and by our Privacy Policy and Returns & Refund Policy, each incorporated here by reference. If you do not agree to these Terms, please do not use the Site or place an order.
1. Eligibility
By using the Site or placing an order, you represent that you are at least the age of majority in your province, state, or country of residence, or that you are using the Site under the supervision of a parent or guardian. You agree to provide accurate, current, and complete information when placing an order.
2. Products
2.1 Descriptions and images. We work to describe and display our products as accurately as possible. However, we do not warrant that product descriptions, colors, or other content are complete or error-free. Colors shown on screen may vary depending on your device and display settings.
2.2 Thermochromic (color-change) feature. Our balaclavas are made with heat-reactive thermochromic fabric that changes color in response to temperature, including body heat and breath. You acknowledge and agree that:
- The color-change effect is a decorative and novelty feature, not a performance, safety, or protective function.
- The speed, intensity, and range of the color change vary with ambient temperature, humidity, airflow, and individual body heat, and may differ from the images shown on the Site.
- Thermochromic dyes are consumable and may fade or diminish in intensity over time and with repeated washing, wear, and exposure to sunlight or heat. Gradual reduction of the color-change effect through normal use is expected and is not considered a defect.
- Following the care instructions provided helps preserve the effect, and failure to follow them may accelerate fading.
2.3 Not protective equipment. Our balaclavas are apparel and fashion accessories intended for warmth and coverage during recreational activities. They are not personal protective equipment (PPE) and are not certified or intended to protect against impact, fire, extreme cold, chemicals, respiratory hazards, or any other risk. Do not rely on this product for protection in any situation where injury could result.
2.4 Sizing. Products are offered in a "one size fits most" format based on the measurements stated on the product page. Fit may vary by individual. It is your responsibility to review the stated measurements before purchasing.
2.5 Availability. All products are subject to availability. We reserve the right to limit quantities, discontinue any product, or refuse or cancel any order at our discretion.
3. Orders, Pricing, and Payment
3.1 Prices. All prices are listed in [CURRENCY, e.g. CAD] and are subject to change without notice. We reserve the right to correct any pricing errors, and to cancel any order placed at an incorrect price, even after the order has been confirmed.
3.2 Order acceptance. Your submission of an order is an offer to purchase. We reserve the right to accept or decline your order for any reason, including suspected fraud, ordering errors, or product unavailability. A confirmation email acknowledges receipt of your order; it does not guarantee acceptance.
3.3 Payment. Payment is processed through third-party payment providers (such as Shopify Payments and other listed options). By providing payment information, you represent that you are authorized to use the payment method. You are responsible for any applicable taxes and duties.
3.4 Chargebacks. Fraudulent or unjustified chargebacks may result in cancellation of orders, suspension of your ability to purchase, and recovery of costs where permitted by law.
4. Shipping and Delivery
4.1 Shipping times and costs are estimates and are described on the Site or at checkout. We are not responsible for delays caused by carriers, customs, weather, or other events beyond our reasonable control.
4.2 Risk of loss passes to you upon delivery to the carrier, except where applicable consumer-protection law provides otherwise.
4.3 You are responsible for providing an accurate shipping address. We are not responsible for orders shipped to an incorrect address provided by you.
5. Returns and Refunds
Sales are subject to our Returns & Refund Policy, are also available. Please review it carefully before ordering. In summary, all sales are final, and we do not accept returns or exchanges for reasons of hygiene, except that we will replace or refund items that arrive defective, damaged, incorrect, or that are not delivered due to our error, as set out in that policy. This policy does not limit rights you may have under applicable consumer-protection law.
6. Intellectual Property
All content on the Site — including the GLACR name, logo, product designs, text, graphics, images, and layout — is owned by or licensed to us and is protected by intellectual property laws. You may not copy, reproduce, republish, or use any of this content for commercial purposes without our prior written permission.
7. Acceptable Use
You agree not to use the Site to:
- Violate any law or regulation;
- Infringe our intellectual property or that of others;
- Transmit malware, spam, or harmful code;
- Attempt to gain unauthorized access to the Site or its systems;
- Interfere with the proper operation of the Site; or
- Engage in fraudulent activity.
We may suspend or terminate your access for any violation of these Terms.
8. Disclaimers
8.1 The Site and all products are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except for those warranties or conditions that cannot be excluded under applicable consumer-protection law.
8.2 We do not warrant that the Site will be uninterrupted, secure, or error-free.
8.3 Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that you may have under applicable law and that cannot lawfully be excluded.
9. Limitation of Liability
To the fullest extent permitted by law, GLACR and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising out of or related to your use of the Site or products. Where liability cannot be excluded, our total liability to you for any claim will not exceed the amount you paid for the product giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
10. Indemnification
You agree to indemnify and hold harmless GLACR and its owners and representatives from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your breach of these Terms or your misuse of the Site or products.
11. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Any dispute will be subject to the exclusive jurisdiction of the courts located in Ontario, Canada, except where applicable consumer-protection law entitles you to bring proceedings in your local jurisdiction.
12. Changes to These Terms
We may update these Terms at any time by posting the revised version on the Site with a new "Last updated" date. Changes take effect when posted. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
